The Procedure of Disposition of Juvenile Protection Cases

Object of Protection

  • Juvenile above the age of 14 and under 20 who has committed crime (Article 4(1) of Juvenile law)
  • Juvenile above the age of 12 and under 14 who has committed acts which are contrary to criminal law and decrees(Article 4(2) of Juvenile law)
  • Juvenile above the age of 12 and under the age of 20 who has one of the following causes and in. feared to commit acts which are csontrary to criminal laws and decrees in the future in view of his character or circumstances(Article 4(3) of Juvenile law)
    • Juvenile who has a babit of disobeying the just supervision of their guardians
    • Juvenile who breaks away from home without proper reasons
    • Juvenile who associates with a person of criminal nature or a immoral person, or has a habit of impairing his own or other persons moral character

Transfer and Notification

  • Transfered by Police(Article 4(2) of juvenile laws) In case their in a juvenile falling under subparagraphs 2 and 3 of the Article 4 of Juvenile law, The poloice Station chief concerned shall directly transfer him to the Juvenile Division concerned
  • Transfer by prosecutors(Article 49 of Juvenile law) When id deemed, after investigation of Juvenile cases, that there is a crime to be punished with not hearier than a fine or there are causes subject to protection disposition, the prosecutor who has investigated the case shall transfer the case to the competent Juvenile Division
  • Transfer by a court(Article 50 of Juvenile law) When it is deemd, after trial of a juvenile case, that there is crime to be punished with not heavier than a fine or there are causes subject to protection disposition, the court which has conducted the trial shall transfer, by means of ruling, the case to the Juvenile division.
  • Notification cases(article 4(3) of juvenile laws) A guardian or the head of school and social welfare organ, who has found the juvenile falling under one of items of paragraph 1, may notify the Juvenile Division concerned their delinquency.
