Sex Offender Registration
What is personal information registration for?
- Sex offender registration is designed to register and manage personal information of a person who has been convicted of a sexual offense subject to registration, and use the information for prevention and investigation of sexual offense and also partially disclose the information to the public or local residents
Purpose
- (Public) General crime prevention effect to arouse public attention that personal information of sex offender will be registered in government institution’s database for 10-30 years
- (Registration Target) Suppressing sexual offenses by applying emotional pressure that the second offense will be easily exposed due to the personal information registered in the system
- (Investigative Agency) Increased efficiency of investigation as the scope of suspects can be narrowed and the tracking and arresting of the criminal is facilitated using the database of sex offenders

Obligations of Sex Offenders Subject to Registration
Submission of Basic Personal Information
- A person subject to registration must notify their personal information in person to the head of the competent police station within 30 days of the the date of conviction (if detained in a correctional facility, information to be submitted to the head of the facility)

Notification about changes in the information
- Details of changes to be submitted to the head of the competent police station within 20 days from the date on which the reason for change occurred
Mandatory Report of Departure to and Entry from Overseas Countries
- Report of departure submitted to police when departing the country to stay overseas for at least six months
- Report of entry submitted to police within 14 days from the date of arrival
※ Report to the head of the competent police station still required even if the person submitting the report does not depart from the country after submitting a report of departure or cannot enter the country by the scheduled arrival date
Photographing
- Visit to the competent police station to take photos by December 31 each year starting from the year following the submission of personal information
Penalty
- A person who fails to submit the required information, notifies false information, does not visit the police station, or refuses to take photos
Prison labor of up to 1 year or fine of up to KRW 5 million
- A person who fails to submit a report of departure or entry without justifiable reason or files a false report
Penalty of up to KRW 3 million
Exemptions from Registration
What is the Registration Exemption System?
- Registration exempted for the remaining period after objective investigation of requirement fulfillment, such as whether or not the minimum registration period has passed and if the individual has not recommitted a sexual offense
※ Minimum Registration Period: 7, 10, 15 and 20 years for 10, 15, 20, and 30 years respectively
Conditions for Exemption
- Completed execution of the sentenced prison labor or confinement, or full payment of fine
- Completed execution of the order to disclose or announce personal information, order for electronic device attachment, or order for pharmacologic treatment for sexual impulses
- Completion of execution of the probation order, community service order, or order to undergo (or complete) education
No crime of violation of duty during registration period in relation to personal information registration, order for - electronic device attachment order, or order for pharmacologic treatment for sexual impulses
